The Mirena lawyers at Bernstein Liebhard LLP note that court documents indicate plaintiffs in Mirena lawsuits have asked the New Jersey Supreme Court to reconsider an application to designate all such claims filed in the state a MultiCounty Litigation. According to a response filed with the court by Bayer Healthcare Pharmaceuticals last month, the company also supports the establishment of a consolidated proceeding for Mirena lawsuits in Middlesex County Superior Court. In a notice on the Court’s website, the Acting Administrative Director of the Courts has given interested parties until April 21, 2013 to submit comments or objects to the application in writing.*

Court documents indicate that Bayer Healthcare Pharmaceuticals filed its own Application for Centralized Management of Mirena lawsuits with the New Jersey Supreme Court last year, but the request was denied in January.** According to Bayer’s letter supporting the recent Application, 47 lawsuits filed by alleged victims of Mirena side effects are now pending in Morris County Superior Court.*** All of the Mirena lawsuits allege Bayer failed to adequately warn that the device could spontaneously migrate from the uterus leading to serious complications. The complaints further claim Bayer has a history of overstating Mirena’s benefits and understating its significant risks.
Court records also indicate that a number of similar Mirena claims are pending in various federal courts throughout the country. In January, plaintiffs in federally-filed Mirena lawsuits filed a motion with the U.S. Judicial Panel on Multidistrict Litigation (JPML) seeking the establishment of a consolidated litigation in the Northern District of Ohio for those claims. The Panel heard Oral Arguments on the matter on March 22nd. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434 (JPML)) While Bayer supports centralized management for Mirena lawsuits pending in New Jersey state court, the company is opposed to a federal consolidation, according to a Reuters report.****
