With a recent study’s findings showing that pedestrians are usually not at fault when they are struck by motorists, car accident lawyer David Resnick today urged city officials, law enforcement and drivers to take steps to reduce the number of pedestrian accidents in New York City.

“It’s obvious that pedestrians are no match for cars and will suffer the most when the two collide,” said Resnick, a New York City attorney with David Resnick & Associates, P.C., a firm that concentrates on car and pedestrian accidents. “Drivers need to make sure they are aware of pedestrians to prevent these kinds of accidents. And when these accidents do occur, negligent drivers need to be held responsible.”

Resnick cited a study of New York pedestrian and cyclist accidents published in the April issue of the Journal of Trauma and Acute Care Surgery that shows that 6 percent of pedestrians were injured while on a New York City sidewalk. Of those injured on the street, 44 percent used a crosswalk, with the signal, compared with 23 percent who crossed midblock and 9 percent who crossed against the signal.

“This study shows that most New York pedestrians involved in car accidents are doing exactly what they are supposed to do – follow traffic signals,” Resnick said. “Some are even on the sidewalk, where cars definitely don’t belong. Drivers need to take greater care and make sure these dangerous accidents don’t occur in the first place.”

The study, representing the findings of a medical study of injured pedestrians and cyclists in the city, was conducted by a team of trauma surgeons, emergency physicians and researchers from NYU Langone Medical Center.

The New York Times cited the research in a recent article with the headline, “Crosswalks in New York Are Not Havens, Study Finds.”

The study reports that in 2010, 11,000 pedestrians were injured by motor vehicles in New York City. Conclusions of the research include, “Prevention modalities must be tailored accordingly with a focus on high-risk subgroups and compliance with traffic laws.”

Resnick said, “Studies like this one are the tip of the iceberg. We must do more to protect pedestrians in New York City.”

New York pedestrian accidents have a variety of causes. The New York City Department of Transportation (DOT) put together a New York City Pedestrian Safety Study & Action Plan. Key findings include:

  •          Pedestrians are 10 times more likely to die than a motor vehicle occupant in a crash.
  •     Pedestrians accounted for 52 percent of traffic fatalities from 2005-2009.
  •     Driver inattention was cited in nearly 36 percent of accidents resulting in pedestrians being killed or seriously injured.
  •     A driver’s failure to yield was involved in 27 percent of fatal pedestrian crashes.
  •     Twice as many deaths occurred in pedestrian crashes that involved a speeding driver.
  •     Most New Yorkers are unaware that the city’s standard speed limit is 30 mph.
  •     Private vehicles, not taxis, trucks or buses, are involved in 79 percent of crashes that kill or seriously injure pedestrians.

“All of these statistics show that most of the time, the driver of a vehicle is the one responsible for causing accidents that hurt and kill pedestrians in New York City,” Resnick said.
