The study, conducted by the Workers Compensation Research Institute, found injured workers were concerned about whether they can trust their workplace through the complex and burdensome claims process, and what options they have if their claim is denied. Adding further emotional weight to the seriousness of the matter, workers believed their injuries were so severe that the future well-being of themselves and their families depended on winning the case, according to the study.

The study tracked 7,000 claims records involving workers in eleven states, including Tennessee, who lost more than a week of time due to injury. Overall, Tennessee ranked second, with a little over thirty percent of injured workers hiring personal injury attorneys to represent them. Maryland was first, at fifty percent, while Texas was last, at eight percent.

Meade noted that an employer can refuse to acknowledge the on the job injury or an insurance company could deny a legitimate workers’ compensation claim on a technicality. In both cases, he said, the companies are in the business of making a profit, which does not happen when they pay large settlements in workers’ comp claims. Insurance companies in particular are well-versed in countless methods – some of them legally or ethically borderline – of raising doubts about either the circumstances or seriousness of a work-related injury.

“Whatever an injured worker does, they should never accept the doctor’s impairment rating without consulting an attorney who may be able to get a higher rating,” the Johnson City personal injury lawyer said. “The most likely reason the insurer is making the offer is because they know the injured worker may be entitled to much, much more money and they are afraid of what will happen to their bottom line if the worker pursues the claim with the assistance of legal representation.”
