According to court documents (Cause No: 2013CI01907, in the 438th Court of Bexar County, Texas), the attorneys at Grossman Law Offices have filed suit following a fatal drunken driving accident in San Antonio. The suit alleges Jorge Badillo, Jr. died as a result of the over-service of alcohol to an already intoxicated patron, who was then allowed to drive.

The lawsuit claims on or about October 26, 2012, a patron at La Vikina Bar & Grill was served alcohol and continued service when it should have been apparent that the patron was intoxicated. The patron was allegedly intoxicated to a state that she presented a “clear danger” to herself and to others. The patron then left La Vikina, purportedly traveling the wrong-way along Highway 151 and struck the vehicle of Jorge Badillo, Jr. head-on. Badillo Jr. died as a result of the injuries sustained in the accident.

Attorney Keith Purdue commented on the accident, “While the driver is a large focus of the lawsuit, this suit also recognizes the potential danger of bars and restaurants over-serving their clients.”

Attorney Purdue continued, noting the culture of the bar scene. “A dram shop suit (a suit which asserts both the liability of the driver and the alcohol provider) puts the bar on notice that their practices must change. In one instance it may be a lack of training, in another it may be a push for profits, but at the end of the day, patron safety must be the top priority.”

The suit seeks both wrongful death and survival damages for the victim’s family, as a result of the accident. Attorney Purdue continued, “A culture change in the bar scene is definitely an objective of a dram shop lawsuit. However, the victim and his family have actual financial losses attributed to this incident which must addressed. Most understand the medical and emergency costs of an accident, but the family has also lost a major source of financial stability.”
