Transvaginal mesh lawsuit claims involving products manufactured by C.R. Bard, Inc. continue to move forward in a consolidated litigation underway in New Jersey’s Atlantic County Superior Court, Bernstein Liebhard LLP reports. According to court records, an Amended Bellwether Scheduling Order was issued by Superior Court Judge Carol E. Higbee on May 31st that, among other things, sets forth a schedule for the depositions of expert witnesses in the litigation’s bellwether cases. According to the Order, the first trial of a C.R. Court filings show that 550 C.R. Bard vaginal mesh lawsuits were pending in Atlantic County Superior Court as of June 8, 2013. All of the lawsuits allege that transvaginal mesh products marketed by C.R. Bard caused plaintiffs to suffer serious complications, and accuse the company of failing to provide adequate warnings about their risks. Court documents further indicate that more than 2,900 transvaginal mesh lawsuits involving products marketed by Johnson & Johnson’s Ethicon unit are also pending in a second consolidated litigation underway in Atlantic County. In March, the first trial in the Ethicon litigation concluded with a jury awarding more than $11 million in compensatory and punitive damages to a woman who suffered injuries due to the Gynecare ProLift transvaginal mesh product. C.R. Bard is named in hundreds of additional transvaginal mesh lawsuits that have been consolidated in a multidistrict litigation in U.S. District Court, Southern District of West Virginia. Bard multidistrict litigation, according to court records.
