The transvaginal mesh lawyers (http://www.vaginalmeshlawsuit2015.com/) at Bernstein Liebhard LLP report that the multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, for claims involving pelvic mesh products manufactured by American Medical Systems, Inc. continues to move forward. On March 15th, the Court issued an Order allowing the deposition of two former American Medical Systems’ employees, rejecting the Company’s request that the depositions be prohibited. In doing so, the Court determined that American Medical Systems had failed to meet the high standard required for issuance of a protective order that would have disallowed the depositions. Vaginal Mesh Lawsuits
In July 2011, the U.S. Food & Drug Administration (FDA) warned that transvaginal mesh complication reports associated with pelvic organ prolapse repair had increased five-fold since 2008. Thousands of women have since filed vaginal mesh lawsuits in both federal and state courts seeking compensation for injuries that allegedly followed implantation of products manufactured by American Medical Systems, Boston Scientific Corp., C.R. Bard, Inc. and Johnson & Johnson’s Ethicon, Inc. unit. Court records indicate that American Medical Systems is facing more than 5,000 such claims in the Southern District of West Virginia.

In addition to the American Medical Systems litigation, several other vaginal mesh proceedings are moving forward in the Southern District of West Virginia, including: In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); and In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”), and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2327”). Bernstein Liebhard LLP partner, Jeffrey S. Grand, is also serving on the Plaintiffs’ Steering Committees in these litigations. Court documents show that the first of the litigations’ bellwether trials, involving a C.R. Bard product, is scheduled to begin in June.

In addition, Mr. Grand is serving as Co-Liaison Counsel in two consolidated litigations underway in New Jersey’s Atlantic County Superior Court. He was also a member of the trial team for the first Ethicon mesh lawsuit trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff.
