Resorb Networks, Inc. today is defending its trademark FacePiles™ from Facebook, Inc’s false claims, which were made on March 9th, 2011 in the form of an opposition to Resorb Networks, Inc’s pending trademark application.

Resorb Networks, Inc. recently received notice of an opposition (Opposition #91198929) to its pending trademark application for the term “FacePiles”; which Resorb Networks, Inc uses, and has been using for over 14 months; for one of its many interactive applications by the same name which is located at http://www.facepiles.com.

The FacePiles™ service, which has just recently been re-released to the public after the initial beta testing since January 2010 allows people to categorize and search videos on the web; based on the physical characteristics of the individuals involved in the content.

The opposition comes after settlement negotiations between the two companies fell through; and Facebook, Inc. notified Resorb Networks, Inc. that if the FacePiles™ service was re-released to the public, that they would pursue further action.

A number of claims made by Facebook, Inc. in the opposition are seemingly fabricated in nature, mis-representing Resorb Networks, Inc's primary business focus, and have no merit; the full opposition filing can be found here; as such, Resorb Networks, Inc will be filing an answer to Facebook, Inc’s claims within the coming weeks per the USPTO’s Trademark Trial and Appeal Board process.

Resorb Networks, Inc. believes that Facebook, Inc. is infringing upon its trademark, FacePiles™, as Resorb Networks claimed Priority Date precedes Facebook's claimed Priority Date, as outlined in Resorb Networks, Inc's trademark application. Along with this, Resorb Networks, Inc. also believes that Facebook, from its earliest contact with Resorb Networks, has been acting in bad faith; which is alleged by Resorb Networks due to the unsupported and calumniatory claims made in the opposition.

Resorb Networks, Inc. shall protect and defend vigorously its trademark FacePiles™; taking whatever legal steps necessary to do so.
