Morris of Morris and Associates, a San Diego personal injury attorney who dedicates his law practice to serving clients who have been injured because of the negligence, recklessness and intentional conduct of others, hereby announces that he has requested that the court enter a default judgment against a defendant who allegedly did not properly respond to the claim in an active California personal injury lawsuit.

Specifically, this lawsuit was originally filed on January 25, 2012 against Tomales Pepe, a restaurant in San Diego. The case was assigned to the San Diego County Superior Court and it was assigned a case number of 37-2012-00091236-CU-Po-CTL. The case was filed on behalf of the firm’s client, Ms. Peralta and an amended complaint was filed on February 3, 2012.

According to court documents, this California personal injury lawsuit was originally filed after an incident at Tomales Pepe whereby the plaintiff was using gas-powered equipment at the defendant’s premises. The claim further alleged that the defendant was negligent because it allowed the plaintiff to use this equipment despite the fact that it was not functioning properly. As a result of using this equipment, a gas explosion allegedly occurred and the plaintiff suffered severe burns to her face and her neck.

The complaint was amended on February 3 because the discovery phase of this lawsuit revealed that the defendant allegedly had a relationship with different entities and foreign nationals that provided the employer with actual knowledge that the gas-powered equipment was not functioning properly and therefore dangerous. The amended complaint further alleges that the defendant was aware of this risk when the plaintiff was ordered to use the equipment at issue anyway.

Given that the defendants have allegedly failed to properly respond to this California lawsuit, San Diego personal injury lawyer Stephen B. Morris has requested that the court enter a default judgment against the defendant. This default judgment, if entered, would award the plaintiff with the damages that she seeks for her medical costs, her lost income, her pain and suffering and other forms of loss.
