Daniel Gilleon, a San Diego personal injury lawyer and a partner in the law firm of Mitchell | Gilleon, appeared recently on Fox 5 San Diego’s news broadcast to provide insight and perspective with regards to the potential legal options that are possessed by those who are injured on a cruise ship and by those who lose family members in cruise ship accidents by way of personal injury lawsuits and/or wrongful death lawsuits.

Specifically, Mr. Gilleon appeared on Fox 5 San Diego to discuss the recent tragedy in Italy that occurred when a cruise ship accident allegedly ran into a reef off the coast of Giglio, Italy in January 13 from the standpoint of a San Diego personal injury lawyer. To date, 15 people have been declared dead as a result of the shipwreck and 24 additional people have not been located by rescue workers.

Unfortunately for many who take cruises, they must sign contracts with the cruise lines that limit the liability that the cruise lines can face with regards to damages for accidents that occur. Mr. Gilleon specifically stated that many people who lose loved ones in these accidents may simply choose to let the matter pass without seeking legal remedy. He also stated that passengers are not going to be allowed on a cruise ship without signing what he believes is essentially a waiver of a lot of rights.

People who do suffer through the death of a loved one on a cruise ship can often seek legal redress from the cruise line, but the damages that can be collected are often limited to direct losses that relate to funeral expenses and lost income based on the death of a family member. The broadcast went on to state that damages for pain, grief or bereavement cannot be pursued.
