The case is Garcia v. Oceanside Police Department, #37-2011-001-1110-CU-WT-NC filed in the San Diego Superior Court.
Specifically, Mr. Gilleon represents former Oceanside police officer Gilbert Garcia, who claims that he was terminated for refusing to destroy evidence regarding an alleged drunk driving offense by an Oceanside police officer who remains active on the force. On the night in question, a resident who lives near the police officer who was questioned with regards to driving drunk called the police to complain about that driver and stated that he drank a beer in front of them and then tossed an empty beer can onto the street.
According to documents filed at the San Diego Superior Court, the Oceanside police were called to investigate the matter, and they soon traced the vehicle to the home of the other officer. An audio recording was made of some of the initial questioning, and San Diego trial attorney Daniel Gilleon stated that this audio tape includes an outright admission that he had been drinking and that he would register above the legal limit for alcohol in California if he was tested for alcohol content at that time.
Officer Garcia was allegedly ordered to destroy the audio evidence regarding the incident by his superior, and Officer Garcia’s order was also allegedly approved by the Oceanside police chief. The California wrongful termination lawsuit claims that when Officer Garcia refused to do so, he was terminated for a prior incident that was then classified as sexual harassment. Attorney Gilleon appeared on Channel 10, Channel 5 and Channel 8 on February 10 to discuss these details regarding the case.
