According to court documents, the driver was stopped by the Florida Highway Patrol because her tag light was out, which is a non moving, equipment violation. During the stop, the trooper noted an odor of alcohol, bloodshot, watery eyes, and slurred speech. He requested that the driver perform field sobriety tests, and she complied. Based on the performance on the field sobriety tests, the trooper believed the driver to be under the influence of alcohol. He arrested her and transported her to jail, where she was asked to take a breath test. She refused.
