Hundreds of Stryker hip lawsuits (http://www.strykerhiprecallclaims.com/ ) filed on behalf of patients who were allegedly injured by Rejuvenate and ABG II Modular-Neck Hip Stems are continuing to move forward in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to court documents, the proceeding’s first Case Management Conference of 2014 has been scheduled for January 28th at 11:00 a.m. As of December 24, 2013, at least 600 product liability claims related to the 2012 Stryker hip recall for Rejuvenate and ABG II hip stems were pending in the New Jersey multicounty litigation. Stryker Hip Recall
Stryker announced the Rejuvenate and ABG II hip stem recall in July 2012, after post-market data indicated the metal components were prone to fretting and corrosion at the modular neck junction, placing recipients at risk for pain, swelling, adverse local tissue reactions, and premature failure of their hip implant. All patients fitted with Rejuvenate and ABG II hip stems have been advised by Stryker to undergo imaging and blood tests to ensure their hips are functioning properly, even in the absence of symptoms. Some asymptomatic patients have nevertheless suffered adverse local tissue reactions and elevated levels of metal ions in their blood, according to the company.*

According to court documents, a program for early mediation of some Stryker hip lawsuits is now underway in Bergen County Superior Court. Already, Phase I of early mediation has resulted in four Stryker hip settlements. Ten cases were selected for the Phase I mediation, and mediation efforts will begin this month in four of those remaining lawsuits. The parties were unable to reach resolution in the two final cases chosen for the first phase of early mediation. Court records indicate that Phase II of early mediation is about to get underway, and the parties have been directed to select 42 cases for the early mediation pool no later than January 10, 2013.

A multidistrict litigation for federal product liability claims related to the Stryker hip recall has also been established in U.S. District Court, District of Minnesota, where at lease 462 lawsuits are pending thus far. Like those filed in the New Jersey proceeding, these claims allege that Rejuvenate and ABG II hip stems can shed dangerous amounts of metal ions into recipients’ tissue and blood stream, resulting in metallosis, adverse local tissue reactions, necrosis, osteolysis, and failure of the hip.
