Stryker hip lawsuits stemming from the July 2012 Rejuvenate and ABG II Modular-Neck Hip Stem recall continue to mount in courts throughout the country, Bernstein Liebhard LLP reports. According to an updated Case List posted on the Court’s website, some 145 Stryker hip replacement lawsuits were pending in a coordinated proceeding now underway in New Jersey’s Bergen County Superior Court as of April 22nd. Stryker Rejuvenate Lawsuits
The Stryker Rejuvenate recall was announced in July 2012, after the metal hip components were found to be prone to fretting and corrosion at the modular neck junction. According to Stryker, this may lead to pain, swelling and adverse tissue reactions that may necessitate early revision of the hip implant. Recently, a report published by the Palm Beach Post raised concerns that revision rates associated with the Stryker Rejuvenate recall could exceed 50%. Florida surgeon, Dr. Robert Zann, reported that his Stryker revision patients have suffered a number of serious complications, including measurable metal contamination on blood tests, and painful, fluid-filled pseudotumors around the artificial joints.*
In addition to the litigation proceeding in New Jersey state court, plaintiffs have also petitioned the U.S. Judicial Panel on Multidistrict Litigation (JPML) to transfer all federally-filed Stryker hip replacement lawsuits to a single federal court for pretrial proceedings. Court documents indicate that some 30 Stryker Rejuvenate lawsuits are already pending in 17 federal districts. Individuals affected by the Stryker Rejuvenate and ABG II hip stem recall should be aware that Stryker has advised that all patients fitted with these components should undergo blood tests and cross-sectional imaging, even in the absence of symptoms. According to the company, some patients have presented with elevated metal ion levels and adverse local tissue reactions, despite reporting no symptoms that would indicate their hip was failing.** Stryker has also retained Broadspire Services, Inc., a third-party claims administrator, to help address patients’ out-of-pocket costs relating to the Stryker Rejuvenate recall.*** Bernstein Liebhard LLP is advising patients that they should consider speaking with an attorney before they begin a Broadspire Stryker claim, as any information they disclose in the course of the claims process could be used as evidence in their Stryker hip lawsuit.
