Bernstein Liebhard LLP notes that a Brief has been filed with the U.S. Judicial Panel on Multidistrict Litigation (JPML) indicating that Defendants in Stryker hip replacement lawsuits have voiced support for the establishment of a multidistrict litigation in Minnesota for all federally-filed claims stemming from the July 2012 recall of Stryker Rejuvenate Modular Neck Hip Stems. (In Re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, Case Pending No. 20 (JPML)) However, according to the March 18th Brief, Howmedica Osteonics Corp., Stryker Corporation, and Stryker Sales Corporation, declined to support the transfer of claims involving Stryker ABG II Modular-Neck Hip Stems to the proposed multidistrict litigation. According to the Defendants, no federal Stryker hip lawsuits have been filed over the ABG II components, though they were recalled as well.

Stryker Hip Replacement Lawsuits
The Stryker Rejuvenate and ABG II hip stems were recalled in July 2012, after data indicated the metal components were prone to fretting and corrosion at the modular-neck junction. Stryker is recommending that all patients fitted with the recalled components undergo metal ion testing and cross sectional imaging to ensure their hips are functioning properly, even if they are not experiencing symptoms of a failing hip implant. *
On February 19th, a Plaintiff in a federally-filed Stryker hip replacement lawsuit filed a motion with the JPML that sought transfer of all similar federal cases to the U.S. District Court, District of Minnesota for pretrial proceeding. According to that petition, at least 30 Stryker Rejuvenate lawsuits had been filed since the recall in various federal jurisdictions. In their Response, Defendants said they agreed with the Plaintiff’s assertion that Minnesota is the most reasonable and suitable venue for the Stryker hip lawsuits, as 10 cases pending there were already being managed by Senior Judge Richard H. At least 81 additional Stryker hip replacement lawsuits are pending in a consolidated litigation recently established in New Jersey’s Bergen County Superior Court. According to court records, that litigation’s second Case Management Conference was held yesterday, with the third scheduled for April 10th.
