Stryker hip recall lawsuits continue to move forward in a consolidated litigation recently established in New Jersey’s Bergen County Superior Court for product liability claims stemming from the July 2012 recall of Rejuvenate and ABG II Modular-Neck Hip Stems, Bernstein Liebhard LLP reports. According to a Case Management Order issued by the Court on February 20th, Superior Court Judge Brian R. Martinotti has directed the parties to meet and confer on certain discovery related issues. Court records indicate that as of February 20, 81 Stryker Rejuvenate lawsuits were pending in the New Jersey litigation. Stryker Rejuvenate Lawsuits
All of the Stryker hip recall lawsuits pending in the New Jersey litigation were filed in the wake of the Stryker Rejuvenate recall, which was announced on July 6, 2012, after data indicated the metal hip stems were prone to fretting and corrosion at the modular neck junction. The company has since advised that patients fitted with the recalled components undergo metal ion testing and cross sectional imaging, even if they are not experiencing symptoms of a failing hip implant. According to its most recent recall update, some patients have experienced high levels of metal ions in their blood and/or adverse local tissue reactions, even in the absence of symptoms.*

Stryker has also a retained Broadspire Services, Inc., a third-party claims administrator, to work directly with patients to manage medical claims and address out-of-pocket costs relating to the Stryker Rejuvenate recall.** Bernstein Liebhard LLP is urging potential claimants to seek legal advice before they begin a Broadspire Stryker claim. Any information disclosed as part of a Broadspire Stryker claim could be used as evidence later in their Stryker Rejuvenate lawsuit.**

Court records indicate that plaintiffs in federally-filed Stryker hip recall lawsuits are also seeking the consolidation of those claims in a single federal court for pretrial proceedings. According to a February 19th petition filed with the U.S. Judicial Panel on Multidistrict Litigation, plaintiffs have requested that the Stryker Rejuvenate lawsuits be transferred to the U.S. District Court, District of Minnesota.
