The U.S. Judicial Panel on Multidistrict Litigation (JPML) will discuss the possible consolidation of all federally-filed Stryker hip lawsuits related to last year’s recall of Rejuvenate and ABG II Modular-Neck Hip Stems at its May 30th hearing session, Bernstein Liebhard LLP notes. According to a Notice to All Involved Counsel issued by the Panel on April 4th, nearly 30 Stryker Rejuvenate lawsuits are currently pending in various federal courts. Court documents indicate that Plaintiffs have requested that the proposed multidistrict litigation be established in U.S. District Court, District of Minnesota. Other plaintiffs have requested the lawsuits be transferred to the Northern District of Illinois. Stryker Hip Replacement Recall
Dozens of Stryker hip lawsuits were filed in state and federal courts throughout the country following the July 2012 announcement of the Rejuvenate and ABG II hip stem recall. The Stryker hip replacement recall was issued after data indicated the metal hip stems were prone to fretting and corrosion at the modular neck junction. Stryker has since advised that patients fitted with the recalled components undergo metal ion testing and cross sectional imaging, even if they are not experiencing symptoms of a failing hip implant. According to its most recent recall update, some patients have experienced high levels of metal ions in their blood and/or adverse local tissue reactions, even in the absence of symptoms.*

Earlier this year, Stryker announced that it had retained Broadspire Services, Inc., a third-party claims administrator, to work directly with patients to address out-of-pocket costs relating to the Stryker Rejuvenate recall.** Bernstein Liebhard LLP is advising patients that they should consider speaking with an attorney before they begin a Broadspire Stryker claim, as any information they disclose in the course of the claims process could be used as evidence in their Stryker hip lawsuit.**

Court records indicate that at least 81 additional Stryker Rejuvenate lawsuits have been filed in a state litigation underway in New Jersey’s Bergen County Superior Court.
