The Stryker hip lawyers at Bernstein Liebhard LLP are looking forward to next week’s Status Conference in the Stryker hip recall litigation now underway in New Jersey’s Bergen County Superior Court. Judge Brian R. Martinotti, who is overseeing the proceeding, has scheduled the conference for May 15, 2013 at 10:00 a.m. Bernstein Liebhard LLP is representing clients in the New Jersey litigation who have allegedly suffered serious complications associated with Stryker’s recalled Rejuvenate and ABG II Modular-Neck Hip Stems. Stryker Hip Recall
The Stryker hip recall was announced in July 2012, after the Rejuvenate and ABG II hip stems were found to be prone to fretting and corrosion at the modular neck junction. Stryker has advised recipients of Rejuvenate and ABG II hip stems to undergo blood tests for elevated metal ion levels and cross sectional imaging to ensure the components are functioning properly, even in the absence of symptoms.* Stryker hip lawsuit plaintiffs allege they have suffered numerous complications due to the recalled components, including local tissue reactions manifesting with pain and/or swelling, and other adverse outcomes including metallosis, necrosis and osteolysis.
Court documents indicate that at least 145 lawsuits have already been filed in the New Jersey litigation since the Stryker hip recall was announced. According to Orders issued by the Court on April 29th, Defendants have consented to the use of long and short form complaints submitted by Plaintiffs’ attorneys last month. In an earlier Order issued on April 2nd, Judge Martinotti set forth procedures for the parties to begin selecting cases to move toward early mediation. However, his order stipulated that the case against Stryker will continue while mediation takes place.
Earlier this year, a number of plaintiffs in federally-filed Stryker hip replacement lawsuits petitioned the U.S. Judicial Panel on Multidistrict Litigation (JPML) to establish a consolidated proceeding for those claims in a single federal court.
