New York, New York (PRWEB) April 12, 2013
The Stryker hip recall lawyers at Bernstein Liebhard LLP report that Stryker hip lawsuits associated with the 2012 recall of Rejuvenate and ABG II Modular-Neck Hip Stems are moving forward in the consolidated litigation currently underway in New Jersey Superior Court. According to an Order dated April 2nd, Bergen County Superior Court Judge Brian R. Martinotti has ordered each side to pick five Stryker hip recall lawsuits for mediation. Last month, the parties agreed to choose a panel of third-party mediators, four of whom have been chosen. However, the case against Stryker will continue while mediation takes place, according to the Order.* (In re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296)
Bernstein Liebhard, a nationwide law firm representing victims of defective drugs and medical devices, is actively filing Stryker hip recall lawsuits on behalf of alleged victims of Rejuvenate and ABG II hip stems. The Firm offers free legal evaluations to individuals allegedly affected by the Stryker hip replacement recall.
Stryker Rejuvenate and ABG II Recall
The Stryker Rejuvenate recall was announced in July 2012, after the metal hip components were found to be prone to fretting and corrosion at the modular neck junction. According to Stryker, this may lead to pain, swelling and adverse tissue reactions that may necessitate early revision of the hip implant.* Recently, a report published by the Palm Beach Post raised concerns that the revision rates related to the Stryker hip recall could exceed 50%. One doctor interviewed for the report, Dr. Robert Zann, told the Post that the number of Stryker hip patients needing revision surgery has exhausted some doctors. Complications observed by Dr. Zann echo many of those allegedly experienced by Bernstein Liebhard’s own Stryker hip lawsuit clients, including measurable metal contamination on blood tests, and painful, fluid-filled pseudotumors around the artificial joints.**
Court records indicate that 133 Plaintiffs have filed Stryker hip recall lawsuits in the New Jersey litigation. Plaintiffs in federally-filed Stryker hip claims have also petitioned the U.S. Judicial Panel on Multidistrict Litigation (JPML) for transfer of all similar federal cases to the U.S. District Court, District of Minnesota for pretrial proceeding. The JPML has scheduled Oral Arguments on the matter for May 30th. (In Re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, Case Pending No. 20 (JPML))
“Given that some 20,000 Rejuvenate and ABG II hip stems were sold prior to the recall, we expect a large number of Stryker hip lawsuit filings. Our office continues to receive calls from patients who have only just recently learned of the recall or have just received blood test results indicating elevated levels of cobalt and chromium. These callers have questions about the Stryker lawsuits as well as the long term consequences of metal toxicity, ” says Bernstein Liebhard LLP.
Plaintiffs allegedly affected by the Stryker Rejuvenate and ABG II hip recall may be entitled to file a Stryker hip lawsuit to obtain compensation for medical bills, lost wages, and pain and suffering.
