Surgical mesh lawsuit claims are continuing to move forward in a number of federal litigations currently underway in the Southern District of West Virginia, Bernstein Liebhard LLP reports.
According to court documents, a federal multi-district litigation for claims involving transvaginal mesh manufactured by Cook Medical, Inc. was approved on June 11th by the U.S. Judicial Panel on Multidistrict Litigation. Lawsuits alleging injuries caused by the company’s mesh are now pending in the federal proceeding underway in the U.S. District Court, Southern District of West Virginia, where claims involving products from American Medical Systems, C.R. Bard, Boston Scientific and Johnson & Johnson’s Ethicon unit have already been filed in separate litigations. On the date the Cook Medical litigation was approved, court records indicate there were 13 cases filed against the manufacturer in eight federal jurisdictions in the U.S.

The scrutiny surrounding this class of devices has continued to mount since 2008, when the U.S. Food and Drug Administration (FDA) issued its first public health alert warning the public that it had received more than 1,000 adverse event reports from women implanted with the surgical material.** In 2011, the agency revised its stance on the frequency of these complications to occur from “rare” to “not rare” after finding that the number of complaints from vaginal mesh patients increased five-fold over a period of three years.***
