In addition to the high number of disability claims being filed by veterans across the country, the complexity of the claims forms and the process itself can slow the approval of benefits for deserving veterans.
Holiday, FL (PRWEB) April 21, 2012
Tampa veterans’ disability benefits lawyer Lawrence Disparti said today that a recent report on the delay in processing disability claims by the Veterans Administration underscores the crucial role that an attorney can play when applying for benefits.
“In addition to the high number of disability claims being filed by veterans across the country, the complexity of the claims forms and the process itself can slow the approval of benefits for deserving veterans,” said Disparti, founder of the Disparti Law Group.
The firm’s Tampa disability benefits lawyers help clients file for veterans’ disability benefits as well as other types of benefits, including Social Security Disability (SSD) and Supplemental Security Income (SSI).
“Legal assistance at the start of the process to obtain veterans’ disability benefits will ensure that forms are complete and accurate, and that they make the strongest case possible on behalf of the veteran,” Disparti said.
“An experienced veterans’ disability benefits attorney can make sure an application is not rejected because of a mistake or omission, which would further delay a process that is already too slow.”
The New York Times reported April 14 that 870,000 veterans nationwide are awaiting a decision from the VA on a disability claim. The waiting list has more than doubled since 2009 as veterans from three wars have sought disability benefits, according to the report.
The Times said that some 677,000 Iraq and Afghanistan veterans as of October 2011 have returned home and filed disability claims seeking compensation for wounds such as traumatic brain injury (TBI) and post-traumatic stress disorder (PTSD).
Meanwhile, 231,000 Vietnam veterans have filed new disability claims related to diseases that that the government only recently acknowledged were caused by use of the toxic defoliant Agent Orange, the report said.
The federal government has appropriated more than $300 million for a new computer system and hired thousands of VA claims professionals nationwide to handle the increase in veterans’ disability claims.
Eric Shinseki, the secretary of Veterans Affairs, has set a goal to process all disability claims in fewer than 125 days with 98 percent accuracy by 2015, the VA told the Times.
“The VA is also pledging to make its claims forms simpler, but four months is a long time to wait for assistance that many wounded veterans need right away,” Disparti said.
“We may not be able to make the wait shorter,” Disparti said of his firm’s legal services, “but we can help make sure the wait bears fruit, in the form of an approval.”
If Afghanistan, Iraq or Vietnam era veteran has had benefits denied, an attorney can review the VA’s report and the original claim and help develop and file an appeal,” Disparti added.
“A veteran with a service-related disability or who is unable to work because of a service-related injury or disease should not tackle the VA claims process on their own,” Disparti said.
