Federal Court Overseeing Testosterone Lawsuits Issues Order Pertaining to AndroGel Bellwether Trials, Bernstein Liebhard LLP Reports

Testosterone lawsuits (http://www.testosteronelawsuithub.com/) filed against the manufacturers of AndroGel and other testosterone replacement medications continue to move forward in federal court, Bernstein Liebhard LLP reports. According to a Case Management Order issued in the U.S. District Court, Northern District of Illinois, on November 6, 2014, the Court has established a schedule governing bellwether trials for lawsuits filed against AbbVie, Inc., the manufacturer of AndroGel. Among other things, the order directs the parties to select a total of 16 AndroGel lawsuits as possible bellwether candidates by July 11, 2015. By March 1, 2016, the Court will choose six cases for the litigation’s first trials, and designate the order in which the cases will go to trial. The Order states that the first of the AndroGel trials will begin on October 31, 2016. (In re: Testosterone Replacement Therapy Product Liability Litigation - MDL No. 2545)

Testosterone Litigation
Court documents indicate that more than 220 testosterone treatment lawsuits have been filed in the federal litigation underway in the Northern District of Illinois, where all federally-filed product liability claims involving these medications have been consolidated in a multidistrict litigation for coordinated pretrial proceedings. All of these cases similarly allege that the use of drugs like AndroGel increases a patient’s risk for life-threatening cardiovascular events, including heart attacks, strokes and blood clots. The lawsuits further allege that the manufacturers of testosterone therapies engaged in aggressive marketing that encouraged men without any real medical need to seek treatment for low sex drive, fatigue and other symptoms merely associated with aging.

The U.S. Food & Drug Administration (FDA) has been reviewing the safety of low testosterone therapy since January, after two studies suggested that testosterone replacement therapies might increase the likelihood of strokes, heart attack and death in older men, as well as those with pre-existing heart disease. In September, a panel of outside advisors convened by the FDA recommended that the manufacturers of the medications be required to conduct studies of their cardiovascular side effects. The advisors also recommended that the labeling for low testosterone therapies be revised to make clear they have not been shown to lessen symptoms commonly experienced by aging men.*
