According to the Court’s calendar, the proceeding’s next Case Management Conference will be convened on Tuesday, May 19, 2015 at 1:30 p.m. A Joint Agenda submitted to the Court on May 14th indicates that the Conference will address, among other things, matters pertaining to discovery and the bellwether trial process. According to court documents, more than 1,400 testosterone lawsuits are currently pending in the litigation underway in the Northern District of Illinois. All of the claims were filed in the wake of the U.S. Food & Drug Administration’s (FDA) January 31, 2014 announcement that it was reviewing the cardiovascular risks potentially associated with testosterone therapy, and accuse the drug’s manufacturers of concealing their alleged association with heart attacks, strokes, blood clots and other life-threatening complications.* Plaintiffs further assert that low testosterone therapy products were wrongly marketed as appropriate treatments for low libido, muscle loss, fatigue and other symptoms commonly associated with male aging, even though they have never been approved by the FDA for this purpose.
The FDA announced the results of its safety review on March 3, 2015, stating that the labels of prescription testosterone treatments would be updated with information regarding a potential association with heart attack and stroke. The agency also mandated that language pertaining to their approved indications be modified to clearly state that testosterone therapy has not been proven safe and effective for relieving symptoms associated with age-related drops in testosterone.
