Litigation Continues in Skechers Shape-Ups Toning Shoes Injury Claims, Says Baltimore Product Liability Lawyer

Jenner issued a statement today to remind consumers that injury claims involving Skechers Shape-Ups toning shoes are being litigated separately from claims that resulted in the shoe company’s $40 million settlement with the Federal Trade Commission in May.

Kentucky attorney Ronald E. Johnson Jr. of Schachter Hendy & Johnson, PSC, is serving as the other Co-Lead Counsel in the ongoing Skechers multidistrict litigation case in the U.S. District Court for the Western District of Kentucky in Louisville (MDL No. 2308).

On May 16, 2012, the FTC announced that Skechers USA, Inc., had agreed to pay $40 million to settle charges that the company deceived consumers by making “unfounded advertising claims” that Shape-Ups would help people lose weight and strengthen and tone their buttocks, legs and abdominal muscles.

“Since May, our law firm has received more than 10,000 inquiries regarding the FTC’s settlement with Skechers,” Jenner stated. “This indicates to us that people across the country are dissatisfied and troubled about the fact they were sold this product.

“Our firm is happy to give guidance about the FTC process, while we continue to investigate personal injury claims for people we believe have been tragically hurt by these shoes. The two tracks, however, are different.

“We would like to make clear for the general public that the FTC settlement and the ongoing litigation that our law firm is leading in the U.S. District Court for the Western District of Kentucky involve separate and distinct legal claims and proceedings.

“The FTC settlement resolved allegations that Skechers made deceptive and false advertising claims about its toning shoes. This litigation involves a return of the purchase price of the shoes. The ongoing Skechers MDL in Kentucky, on the other hand, involves claims that serious physical injuries were caused by Skechers’ rocker bottom toning shoes.

“In particular, we contend that the very design of these shoes altered our clients’ gait and caused severe lateral instability, which in turn placed them at a heightened risk of developing chronic injuries such as stress fractures of the feet, legs and hips, in particular. Moreover, acute injuries caused by the instability, such as fractures caused by falls, are also common among wearers of rocker bottom shoes.

“Furthermore, we contend that Skechers promoted its toning shoes as having multiple health benefits compared to ordinary athletic shoes while knowing the shoes do not confer those benefits and while failing to warn consumers of the shoes’ serious additional risks.
