The C.R. Bard transvaginal mesh lawsuit bellwether trial is progressing in West Virginia, reports The Rottenstein Law Group LLP, a law firm that represents hundreds of women in transvaginal mesh lawsuits. On the second day of trial, on July 30, some of the plaintiff’s expert witnesses took the stand, including the physician who implanted plaintiff Donna Cisson with the Bard Avaulta mesh, according to court documents.
Cisson alleges that Bard’s transvaginal mesh implant was designed defectively and caused her to suffer serious injury, according to court documents in Cisson v. C. R. Bard, Inc. (MDL-2187; 2:11-cv-00195; U.S. District Court for the Southern District of West Virginia). Dr. Brian Raybon, the witness, was the first doctor in the United States to implant an Avaulta, according to court documents.
“This time around it is less likely that an expert witness will stray beyond the judge’s guidelines when testifying,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP, referring to the case’s previous trial ending in a mistrial because a witness testified about Bard’s marketing practices despite Judge Joseph R. Goodwin’s ruling that witnesses should not do that, according to a July 10 Bloomberg story.*
Women who have filed vaginal mesh lawsuits assert that the devices have caused them to suffer several serious potential side effects since implantation, including vaginal erosion. Recent vaginal mesh awards include a 2012 verdict in California against Bard which resulted in a $5.5 million damages award.**
