Ethicon Vaginal Mesh Lawsuit News: Bernstein Liebhard LLP Notes Release of New Order in Federal Ethicon Mesh Litigation Concerning Upcoming Bellwether Trial

Thousands of vaginal mesh lawsuits (http://www.transvaginalmeshlawsuitclaims.com/ ) filed over injuries allegedly caused by Ethicon, Inc.’s Gynecare pelvic mesh devices continue to move forward in a multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia. According to the Third Amended Docket Control Order issued on December 11, 2013, the Court has directed that case specific discovery for the litigation’s first bellwether trial is to be completed by December 31, 2013. The Order also stipulates, among other things, that a Pretrial Conference will be conducted on January 16, 2014, and that the parties submit jury instructions by January 31, 2014. The first bellwether trial in the Ethicon transvaginal mesh litigation is scheduled to begin on February 10, 2014, according to the Order. Ethicon Transvaginal Mesh Lawsuits
Ethicon, Inc., a unit of Johnson & Johnson, is facing more than 12,500 transvaginal mesh lawsuits that have been filed in the Southern District of West Virginia. More than 4,560 additional claims involving Gynecare products are also pending in a multicounty litigation underway in New Jersey’s Atlantic County Superior Court, where Mr. Grand is also serving as Co-Liaison Counsel. All of the lawsuits similarly allege that Ethicon’s Gynecare products caused women to suffer serious transvaginal mesh complications, including mesh erosion and shrinkage, chronic pain, infections, and organ damage. The complaints further allege that the devices were defectively designed and manufactured, and that Ethicon failed to warn doctors and patients about their serious risks.

One Ethicon vaginal mesh lawsuit has already gone to trial in the New Jersey litigation, and concluded in March with the jury awarding more than $11 million in compensatory and punitive damages to a woman who suffered serious transvaginal mesh complications due to the Gynecare Prolift device. Mr. Grand also served on the Plaintiff’s trial team. (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey)

In addition to his work on the state and federal Ethicon litigations, Mr. Grand is also a member of the Plaintiffs’ Steering Committees for three other federal vaginal mesh proceedings, including: American Medical Systems, Inc. (MDL No. 2325);Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187).
