Thousands of vaginal mesh lawsuits (http://www.filevaginalmeshlawsuit.com/) filed against Ethicon, Inc. continue to move forward in a multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to an Order dated December 2nd, the proceeding’s third bellwether trial will begin on March 2, 2015. Court documents indicate the case selected for trial was filed on behalf of a woman who suffered serious transvaginal mesh complications allegedly associated with Ethicon’s Gynecare Prolift Anterior Pelvic Floor System, a surgical mesh device used to treat pelvic organ prolapse. Ethicon Mesh Litigation
According to court documents, more than 22,000 claims have been filed in the Southern District of West Virginia on behalf of women who were allegedly injured by Ethicon’s transvaginal mesh devices. All of the claims similarly allege that these products were defectively designed and manufactured, and that Ethicon failed to provide adequate warnings regarding their association with organ damage, mesh erosion, infection, and other serious vaginal mesh complications. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is serving on the Plaintiffs' Steering Committee for the federal Ethicon proceeding. In September, the jury hearing arguments in the litigation’s second bellwether case awarded $3.27 million to a woman who suffered serious vaginal mesh complications due to the erosion of the Ethicon TVT-O Mesh sling. (Huskey v. Ethicon, Inc. et al, Case No. No. 2:2012cv05201)
Court records indicate that the federal proceeding’s first bellwether trial concluded last February with a directed verdict in favor of the defense. (Lewis et al v. Johnson & Johnson et al, No. 2:2012cv04301)
In addition to his work on the federal Ethicon litigation, Mr. Grand is serving as Co-Liaison Counsel in a Multicounty Litigation underway in New Jersey Superior Court involving Ethicon mesh products. He was also a member of the Plaintiff’s trial team for its first bellwether trial, which ended in March 2013 with the jury awarding more than $11 million in compensatory and punitive damages to a woman injured by the Gynecare Prolift device. Court records indicate that more than 65,000 transvaginal mesh lawsuits are currently pending in several litigations underway in the Southern District of West Virginia.
