As transvaginal mesh lawsuits ( ) continue to move forward in U.S. courts, Bernstein notes that last week’s $3.27 million verdict against Ethicon, Inc. is having an impact far beyond the U.S. According to a report from the Scottish Daily Mail, women in Scotland are lauding the verdict, with one member of the group Scottish Mesh Survivors asserting that the outcome of the U.S. trial is “of huge significance because so many women in Scotland were fitted with this device.” The report notes that more than 400 women in Scotland are pursing legal claims against mesh manufacturers, and that use of transvaginal mesh has been suspended there because of concerns surrounding their safety.*

Vaginal Mesh Litigation
Court documents indicate that Ethicon has been named in more than 33,000 vaginal mesh lawsuits that are currently pending in state and federal courts. The majority of these claims have been filed in a federal multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia. Bernstein Liebhard LLP partner, Jeffrey S. On September 5th, the jury hearing the litigation’s second bellwether trial returned a $3.27 million verdict in favor of a woman who suffered complications related to the erosion of Ethicon’s Gynacare TVT O-Mesh device. According to court documents, the jury found that the company sold a defective product and failed to provide patients and doctors with information about its risks. (Huskey v. Ethicon, Case No. 12-5201)

Court records indicate that Ethicon has lost two other transvaginal mesh cases that have gone to trial on the state level. In March 2013, a New Jersey Superior Court jury awarded more than $11 million in compensatory and punitive damages to a woman who was injured by the Gynecare Prolift device. Mr. Grand is currently serving as Co-Liaison Counsel in the Ethicon mesh litigation underway in New Jersey, and was a member of the Plaintiff's trial team. (Gross v. Gynecare Inc., Atl-L-6966-10)

In April 2014, jurors hearing a case in Texas awarded $1.2 million to another victim of TVT-O mesh. (Batiste v. McNabb, No. 12-14350, District Court for the 95th Judicial District, Dallas County Texas)

According to court documents, a number of other vaginal mesh litigations involving other device manufacturers are currently underway in the Southern District of West Virginia. Mr. Grand is serving on the Plaintiffs’ Steering Committee in several of these proceedings, including those involving: American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187). He is also serving as Co-Liaison Counsel in a second litigation underway in New Jersey Superior Court for transvaginal mesh lawsuits filed against C.R. Bard.
