Ethicon Transvaginal Mesh Lawsuits
In March, the nation’s first trial involving Ethicon Gynecare mesh complications concluded in the New Jersey litigation, with the jury awarding $3.35 million in compensatory damages, plus $7.76 million in punitive damages, to a woman who experienced transvaginal mesh failure associated with the Gynecare Prolift device. Bernstein Liebhard LLP partner, Jeffrey S. Grand, served on the trial team for the case. (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey).
Mr. Grand is also serving as Co-Liaison Counsel in a second litigation underway in New Jersey Superior Court, Atlantic County, for vaginal mesh lawsuits involving products marketed by C.R. Bard, Inc. Court documents indicate that the first bellwether trial in the New Jersey C.R. Bard litigation will begin on September 23, 2013, and will involve a vaginal mesh device used to treat pelvic organ prolapse. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)
Mr. Grand is also a member Plaintiffs’ Steering Committees in four vaginal mesh litigation’s now underway in U.S. District Court, Southern District of West Virginia: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”); and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2327”).
According to the U.S. Food & Drug Administration (FDA), the most common reasons for transvaginal mesh failure include mesh erosion through vaginal tissue, infection, pain, and urinary problems. In a July 2011 alert, the FDA warned that there had been a five-fold increase in transvaginal mesh problems reported to the agency. At the same time, the FDA also modified its stance on the frequency of transvaginal mesh complications stemming from pelvic organ prolapse repair, stating that it no longer considered the problems to be rare.*
Victims of alleged transvaginal injuries may be entitled to compensation for their medical bills, pain and suffering, and other injuries. A wealth of information regarding vaginal mesh lawsuits can be found at Bernstein Liebhard's website. To learn more, please call 800-511-5092.
