Thousands of transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) alleging injury due to products marketed by C.R. Bard, Inc. continue to move forward in a multidistrict litigation underway in U.S. District Court, Southern District of West Virginia, Bernstein Liebhard LLP reports. According to an Order issued on December 31, 2013, the Court has determined that it requires a more accurate census of claims pending against C.R. Bard. As such, plaintiffs’ attorneys have been directed to register all cases and unfiled claims with the Court no later than January 23, 2014, including those pending in the multidistrict litigation, as well as claims served but not yet filed in the proceeding, transvaginal mesh lawsuits pending against C.R. According to court documents filed in the Southern District of West Virginia, C.R. Bard is currently named a defendant in more than 6,200 transvaginal mesh lawsuits. The proceeding’s second bellwether trial is scheduled to begin on January 10, 2014. (Jones v. C. R. Bard, Inc. 2:11-cv-00114) Court filings show that the multidistrict litigation’s very first C.R. Bard bellwether trial concluded in August, with the jury awarding $2 million in compensatory and punitive damages to the plaintiff. (Cisson v. C.R. Bard Inc., 11-cv-00195)

In addition to his work on the federal multidistrict litigation for claims filed against C.R. Bard, Bernstein Liebhard partner, Jeffrey S. Grand, is also serving on the Plaintiffs' Steering Committees in three other vaginal mesh litigations underway in the Southern District of West Virginia, including: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; and In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327.

Mr. Grand is also serving as Co-Liaison Counsel in multicounty litigations that were established in New Jersey's Atlantic County Superior Court for claims filed in that state against C.R. Bard and Ethicon. In addition, he was a member of the trial team for the proceedings' first Ethicon mesh trial. That case ended in March, after a woman injured by a Gynecare Prolift device was awarded more than $11 million in damages.
