As transvaginal lawsuits (http://www.transvaginalmeshlawsuithelp.com/ ) continue to mount against American Medical Systems Inc., Bernstein Liebhard LLP notes that its parent company, Endo Health Solutions, recently disclosed that it had received an unspecified number of subpoenas from state attorneys general relating to the subsidiary’s pelvic mesh devices. According to a regulatory filing issued by Endo Health on February 28th, the company received a subpoena from the State of California in November 2013, and has subsequently received additional subpoenas from other states. Endo Health said it is fully cooperating with the states’ investigation.*

Transvaginal Mesh Lawsuits
According to court documents, American Medical Systems, which was acquired by Endo Health Solutions in 2011, has been named in more than 16,000 transvaginal mesh lawsuits, most of which have been filed in a federal multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee for this proceeding. Court filings indicate that all of the claims pending in the Southern District of West Virginia similarly allege that pelvic mesh products marketed by American Medical Systems to treat pelvic organ prolapse and stress urinary incontinence caused recipients to suffer serious and debilitating vaginal mesh complications. Plaintiffs further allege that these devices were defectively designed and manufactured, and accuse American Medical Systems of failing to warn patients and doctors about their potential risk.

According to court documents, American Medical Systems is just one of several medical device manufacturers that have been named in transvaginal mesh lawsuits in the Southern District of West Virginia. Mr. Grand is also serving on the Plaintiffs’ Steering Committees in federal proceedings established for claims filed against Boston Scientific Corp., (MDL No. 2326); C.R. Bard, Inc., (MDL No. 2187), and In re: Ethicon, Inc. (MDL No. 2327). More than 40,000 transvaginal mesh lawsuits have been filed in the litigations now underway in West Virginia.

Mr. Grand has also been appointed Co-Liaison Counsel in two multicounty litigations underway in New Jersey Superior Court for transvaginal mesh lawsuits involving products marketed by C.R. Bard and Ethicon. He was also a member of the Plaintiff’s trial team on the first Ethicon trial in that proceeding, which ended in March with a jury awarding $11 million in compensatory and punitive damages to a woman who was harmed by the Ethicon Gynecare Prolift device.
