Vaginal Mesh Lawsuits Move Forward, as Federal Judge Issues Order Pertaining to Final Bellwether Trial in Ethicon Litigation

According to court documents, the federal judge overseeing the litigation has issued an Order pertaining to the proceeding’s final bellwether trial which establishes deadlines for discovery, motions practice and other matters. Transvaginal Mesh Lawsuits
Court documents indicate that more than 16,000 transvaginal mesh lawsuits have been filed against Ethicon in the Southern District of West Virginia. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is serving on the Plaintiffs’ Steering Committee for this proceeding. All of the lawsuits similarly allege that pelvic mesh devices marketed by Ethicon were defective, and caused women to suffer painful, and often permanent, vaginal mesh complications. Plaintiffs further allege that Ethicon failed to provide patients and doctors with adequate warnings regarding the risks associated with these devices.

Court records indicate that vaginal mesh lawsuits began to mount against Ethicon and other companies shortly after the U.S. Food & Drug Administration (FDA) issued the first of two Public Health Alerts in 2008 regarding the potential for serious vaginal mesh complications. At that time, the agency revealed that it had received 1,000 reports of serious injuries associated with the device during a three-year period. In July 2011, the FDA warned that the number of injuries reported in relation to transvaginal prolapse repair had grown three-fold since its prior alert.

In addition to the claims pending in West Virginia, Ethicon is named a defendant in more than 4,700 transvaginal mesh lawsuits that are pending in a multicounty litigation now underway in New Jersey’s Atlantic County Superior Court. Mr. Grand has also been named Co-Liaison Counsel in that proceeding, and served on the Plaintiff's team in its first trial involving an Ethicon lawsuit. That trial concluded last March, when the jury hearing the case ordered Ethicon to pay more than $11 million in compensatory and punitive damages to a woman who was injured by Gynecare Prolift mesh. Mr. Grand is also serving on the Plaintiffs' Steering Committees for three other federal vaginal mesh proceedings underway in the Southern District of West Virginia, including: American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187).
