As transvaginal mesh lawsuits (http://www.transvaginalmeshlawsuithelp.com/) continue to mount in courts around the U.S., Bernstein Liebhard LLP notes that a group of women in Texas are seeking an investigation of Johnson & Johnson. According to a report published by KHOU.com, the women have sent a letter to the Texas Attorney General’s Office asking that it “pursue this matter to recoup the state taxpayer dollars Medicaid and other public health systems have been and will be forced to spend to treat women who have been injured” by Johnson & Johnson’s pelvic mesh devices.*
The signatories of the letter include a woman who was awarded $1.2 million by a Texas jury in April as compensation for serious vaginal mesh complications she sustained from the TVT-O mesh sling, a device marketed by Johnson & Johnson’s Ethicon, Inc. unit. According to court documents, the jury returned the verdict after finding that the device, which was implanted to treat incontinence, was defectively designed. (Batiste v. Transvaginal Mesh Lawsuits
Court documents indicate that more than 19,000 transvaginal mesh lawsuits have been filed against Ethicon and Johnson & Johnson in a federal multidistrict litigation underway in U.S. District Court, Southern District of West Virginia. All of the lawsuits seek compensation for women who have suffered mesh erosion, pain, scarring, organ damage and other vaginal mesh complications allegedly caused by the defective design and manufacture of Ethicon’s pelvic mesh products. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committee for the federal proceeding. More than 5,000 additional Mesh lawsuits are now pending in a multicounty litigation underway in New Jersey’s Atlantic County Superior Court. Mr. Grand was also named Co-Liaison Counsel for this proceeding, and served on the Plaintiff’s trial team for its first trial. That case ended in March 2013 with a jury awarding $11 million in compensatory and punitive damages to a woman who suffered vaginal mesh complications related to the Ethicon Gynecare Prolift device. Mr. Grand also serves on the Plaintiffs’ Steering Committees for several other vaginal mesh litigations underway in West Virginia federal court, including those involving transvaginal mesh lawsuits filed against American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187). In addition, he was appointed Co-Liaison Counsel in a second proceeding involving C.R.
