The court overseeing some 850 transvaginal mesh lawsuits (http://www.drugbot.com/transvaginal-mesh/lawsuit/) pending in a mass tort litigation underway in the Philadelphia Court of Common Pleas has denied a bid by defendants to dismiss hundreds of cases in the proceeding, Bernstein Liebhard LLP reports. According to court documents, American Medical Systems, Inc., Ethicon, Inc., Boston Scientific Corp., and C.R. Bard had sought to have the cases thrown out following the Court’s earlier decision to dismiss claims against Secant Medical, Inc., the litigation’s sole Pennsylvania defendant. In an Order issued on September 2nd, however, the Court ruled that each of the transvaginal mesh lawsuits must be challenged on a case-by-case basis. Vaginal Mesh Litigations

According to court documents, more than 60,000 transvaginal mesh lawsuits have been filed in U.S. courts on behalf of women who suffered mesh erosion, infection, scarring, chronic pain, and organ damage due to implants used to repair pelvic organ prolapse and stress urinary incontinence. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is a member of the Plaintiff’s Steering Committee in several vaginal mesh proceedings underway in U.S. District Court, Southern District of West Virginia, including those involving American Medical Systems, Inc. (MDL No. 2325), Boston Scientific Corp. (MDL No. 2326), C.R. Bard, Inc. (MDL No. 2187) and Ethicon, Inc. (MDL No. 2327).

Court records indicate that the second federal trial of an Ethicon mesh lawsuit concluded in West Virginia on Friday. The plaintiff in that case was awarded $3.25 million for complications associated with the company’s Gynecare TVT Obturator, or TVT-O, implant. (Huskey v. Ethicon, Case No. 12-5201)

In addition to his work on the federal vaginal mesh litigations, Mr. Grand is serving as Co-Liaison Counsel in a Multicounty Litigation underway in New Jersey’s Atlantic Superior Court involving Ethicon mesh products. He was also a member of the Plaintiff’s trial team for its first bellwether trial, which ended in March 2013 with the jury awarding more than $11 million in compensatory and punitive damages to a woman injured by the Gynecare Prolift device.
