Transvaginal Mesh Lawsuit Update: Judge Overseeing Federal Vaginal Mesh Lawsuits Issues Order for Submission of Bellwether Trial Plan

Bernstein Liebhard LLP is now evaluating potential transvaginal mesh lawsuits on behalf of women who suffered serious injuries, including mesh erosion, pain, scarring and infection, allegedly associated with vaginal mesh products.

New York, New York (PRWEB) November 08, 2012

Transvaginal mesh lawsuits filed on behalf of women allegedly injured as a result of vaginal mesh products manufactured by Ethicon, Inc., American Medical Systems Inc., and Boston Scientific Corp. are moving forward in U.S. District Court, Southern District of West Virginia. On November 2, 2012, Judge Joseph R. Goodwin, who is overseeing federal vaginal mesh lawsuits, issued Pretrial Order #22, Submission of Bellwether Plan. Among other things, Judge Goodwin ordered the parties to determine if bellwether trials in three vaginal mesh litigations should begin in 2013. (In re: American Medical Systems, Inc., Pelvic Repair System Products Liability Litigation - MDL No. 2325; In re: Boston Scientific Corp., Pelvic Repair System Products Liability Litigation - MDL No. 2326; and In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation - MDL No. 2327.)*

“We look forward to the commencement of bellwether trials in these transvaginal mesh litigations. We continue to receive inquiries from women on a daily basis who have allegedly sustained horrific injuries following implantation of vaginal mesh products manufactured by all of these defendants,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices, including transvaginal mesh. The firm is currently offering free transvaginal mesh lawsuit evaluations on behalf of women who suffered serious complications following implantation of vaginal mesh devices.

Bernstein Liebhard LLP partner, Jeffrey Grand, is serving as a member of the Plaintiffs’ Steering Committees in all of the above vaginal mesh litigations, as well as in In re: C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation (“MDL No. 2187”), which is also underway in the Southern District of West Virginia. In addition, Mr. Grand has been named Co-Liaison Counsel in two consolidated actions currently pending in New Jersey Superior Court, In re: Pelvic Mesh Litigation/Bard, No. L-6339-10, and In re: Pelvic Mesh/Gynecare Litigation, No. L-6341-10.

Transvaginal Mesh Lawsuits
Transvaginal mesh devices have been under increasing scrutiny in recent years, as more and more women have reported painful complications following transvaginal placement of surgical mesh for the treatment of pelvic organ prolapse and stress urinary incontinence. In July 2011, the U.S. Food & Drug Administration (FDA) warned that there had been a five-fold increase in reports of serious complications associated with the use of transvaginal mesh. The FDA also modified its previous position on the frequency of such complications, stating in the alert that vaginal mesh injuries associated with pelvic organ prolapse repair were not rare.**

Since then, a growing number of transvaginal mesh lawsuits have been filed by women throughout the country who allege they sustained serious, painful and life-changing injuries following implantation of vaginal mesh to treat pelvic organ prolapse and stress urinary incontinence. The first federal vaginal mesh bellwether trial, involving transvaginal mesh products manufactured by C.R. Bard, is scheduled to begin on February 5, 2013 in the Southern District of West Virginia.

Women who suffered complications following implantation of transvaginal mesh may be entitled to compensation for their medical bills, pain and suffering, and other injuries. Bernstein Liebhard LLP is offering free lawsuit evaluations to any woman injured by vaginal mesh devices.
