New York, New York (PRWEB) May 09, 2013
The transvaginal mesh lawyers at Bernstein Liebhard LLP note that the judge overseeing surgical mesh lawsuits in the U.S. District Court, Southern District of West Virginia, has issued a new Preservation Order in the Ethicon mesh litigation. The Order, dated April 25th, addresses the preservation of certain relevant evidence associated with manufacturing facilities affiliated with the Defendants that are preparing to cease or have ceased operations. (In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2327)
“We are pleased to see transvaginal mesh lawsuits moving forward in this litigation. The issuance of this Order will ensure that evidence vital to plaintiffs’ claims is preserved in an appropriate manner,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm’s transvaginal mesh lawyers are currently representing hundreds of women in surgical mesh lawsuits who suffered mesh erosion, pain, scarring, infection and other serious injuries, allegedly due to products marketed by Ethicon, Inc. and other manufacturers.

Court records indicate that Ethicon and other medical device manufacturers have been named in thousands of surgical mesh lawsuits filed on behalf of women who suffered serious injuries, including mesh erosion through vaginal tissue, infection, pain, and urinary problems, allegedly due to mesh products used to treat pelvic organ prolapse and stress urinary incontinence. In addition to the Ethicon mesh lawsuits pending in the federal litigation, thousands of additional claims have been filed in a consolidated litigation underway in New Jersey’s Atlantic County Superior Court. In March, the nation’s first trial involving an Ethicon product concluded in the New Jersey litigation, with the jury awarding more than $11 million to the Plaintiff, Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving as Co-Liaison Counsel in that litigation, and also served on the trial team for that case. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10) In addition, Mr. Grand is Co-Lead Counsel in a second vaginal mesh litigation underway in Atlantic County Superior Court for surgical mesh lawsuits involving products manufactured by C.R. Bard. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10)
Additional transvaginal mesh litigations have also been established in the Southern District of West Virginia, including: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); and In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”). Mr. Grand is also serving on the Plaintiffs’ Steering Committee in these four proceedings.
The litigation surrounding vaginal mesh products used to treat prolapse and incontinence has been growing since July 2011, when the U.S. Food and Drug Administration (FDA) issued a public health alert stating there had been a five-fold increase in transvaginal mesh problems reported to the agency. In the warning, the FDA also re-classified the frequency of transvaginal mesh complications stemming from pelvic organ prolapse repair as “not rare,” which was a change from the position it had taken previously.*
Victims of alleged transvaginal mesh complications may be entitled to compensation for their medical bills, pain and suffering, and other injuries.
