The Order, dated April 25th, addresses the preservation of certain relevant evidence associated with manufacturing facilities affiliated with the Defendants that are preparing to cease or have ceased operations. Court records indicate that Ethicon and other medical device manufacturers have been named in thousands of surgical mesh lawsuits filed on behalf of women who suffered serious injuries, including mesh erosion through vaginal tissue, infection, pain, and urinary problems, allegedly due to mesh products used to treat pelvic organ prolapse and stress urinary incontinence. In addition to the Ethicon mesh lawsuits pending in the federal litigation, thousands of additional claims have been filed in a consolidated litigation underway in New Jersey’s Atlantic County Superior Court. In March, the nation’s first trial involving an Ethicon product concluded in the New Jersey litigation, with the jury awarding more than $11 million to the Plaintiff, Bernstein Liebhard LLP partner, Jeffrey S. The litigation surrounding vaginal mesh products used to treat prolapse and incontinence has been growing since July 2011, when the U.S. Food and Drug Administration (FDA) issued a public health alert stating there had been a five-fold increase in transvaginal mesh problems reported to the agency. In the warning, the FDA also re-classified the frequency of transvaginal mesh complications stemming from pelvic organ prolapse repair as “not rare,” which was a change from the position it had taken previously.*
