Mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) involving transvaginal mesh devices marketed by Johnson & Johnson’s Ethicon, Inc. unit continue to move forward in the multidistrict litigation now underway in U.S. District Court, Southern District of West Virginia. According to a Pretrial Order dated August 5, 2013, the Court has established deadlines for the completion of discovery and other matters pertaining to the first two bellwether trials in the Ethicon mesh litigation. The Order also schedules a Pretrial Conference for January 8, 2014, with the first trial to begin on January 14th. Ethicon Mesh Lawsuits
According to court documents, more than 8,640 Ethicon mesh lawsuits are now pending in the proceeding underway in the Southern District of West Virginia. However, Ethicon is just one of several transvaginal mesh manufacturers facing lawsuits in that jurisdiction. Bernstein Liebhard LLP partner, Jeffrey S. He was also a member of the trial team on the first Ethicon trial in that proceeding, which ended in March with an $11 million verdict for the Plaintiff. The litigation surrounding transvaginal mesh has been growing since October 2008, when the U.S. Food and Drug Administration (FDA) issued its first of two alerts regarding the high number of complications reported in women who received the devices. In a second alert issued in July 2011, the agency warned that vaginal mesh complications associated with pelvic organ prolapse repair were “not rare,” a change from the position it had previously taken.
