Thousands of transvaginal mesh lawsuits (http://www.vaginalmeshlawsuit2015.com/) pending in multidistrict litigations underway in U.S. District Court, Southern District of West Virginia, continue to move forward, Bernstein Liebhard LLP reports. On March 21st, status conferences were held in all of the mesh litigations, including In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326); In re: C.R. Bard, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2187”); and In re: Ethicon, Inc., Pelvic Repair Systems Products Liability Litigation (“ MDL No. 2327”). Among other things, the conference addressed additional trial settings in 2014, as well as the trial schedule. Bernstein Liebhard LLP partner, Jeffrey S. Grand, is serving on the Plaintiffs’ Steering Committees in all four of these proceedings.

Vaginal Mesh Lawsuits
Transvaginal mesh devices are permanently implanted to reinforce the weakened vaginal wall in women suffering from pelvic organ prolapse, and to repair or support the urethra or bladder neck for the repair in women with stress urinary incontinence. In October 2008, the U.S. Food & Drug Administration (FDA) issued a Public Health Notification regarding serious complications associated with the use of vaginal mesh in prolapse and stress urinary incontinence repair. In July, the agency issued an update, after finding that serious complications associated with surgical mesh for transvaginal repair of pelvic organ prolapse are not rare, a change from the position it took in 2008.* Since then, thousands of women have filed vaginal mesh lawsuits against the makers of transvaginal mesh devices in state and federal courts throughout the country.

In addition to the federal vaginal mesh litigations underway in West Virginia, thousands of vaginal mesh lawsuits have been filed in consolidated proceedings in New Jersey Superior Court, Atlantic County. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10; In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10). Bernstein Liebhard LLP partner, Jeffrey Grand is serving as Co-Liaison Counsel in both of these litigations. Earlier this month, the nation’s first trial involving an Ethicon mesh product concluded in the New Jersey litigation, with the jury awarding more than $11 million to the Plaintiff, including $7.76 million in punitive damages. (Gross v. Gynecare Inc., Atl-L-6966-10, Superior Court of Atlantic County, New Jersey (Atlantic City)). Mr. Grand was a member of the trial team.
