Buffalo, NY (PRWEB) June 07, 2013
In the wake of a recent truck accident in New York that killed seven, including four children, Buffalo truck accident lawyer James Morris says that it’s the responsibility of trucking companies to keep their vehicles safe and well maintained.
The tragic accident – which happened less than 200 miles from Buffalo, in Truxton, NY – occurred on Wednesday evening, according to a May 30 Associated Press story titled “Coroner: NY crash victims include 4 kids, 3 adults.” A full investigation is underway to determine the cause, according to the AP. Morris said that no matter the cause, from hazardous road conditions to trucking company negligence, the seriousness of truck accidents cannot be taken lightly.
“Truck accidents can be very dangerous due to their size and weight,” said the Buffalo personal injury lawyer. “Every step should be taken by drivers and their employers to avoid tragedies like this in the future not only in New York, but across the United States,” said Morris.
According to the Associated Press story, Capt. Mark Helms of the Cortland County Sherriff’s Department said that a tractor trailer truck carrying crushed cars was traveling south on Route 13 near the rural town of Truxton when its trailer suddenly became unhitched. The trailer then crossed the center line and hit a minivan, killing seven of the eight passengers on board. Tragically, four of them were children under the age of 10, according to the report.
While the cause is currently under investigation, the Associated Press reports that hazardous road conditions might have been a factor. According to the National Weather Service in Binghamton, N.Y., a line of strong thunderstorms – some of which contained strong winds and hail – moved through the area on Wednesday, with intermittent showers throughout the day.
An experienced Buffalo truck accident lawyer can open up an investigation to such accidents, said Morris. They can review police reports, investigate trucking companies, interview witnesses, and employ an accident reconstruction team to uncover facts that might have been overlooked by law enforcement agencies. They can also examine the scene of the crash to determine if other factors, such as poor roadway design or inadequate highway maintenance, played a role in the accident. If any of these are the case, the situation may call for a lawsuit against a negligent party. An aggressive and determined lawyer also knows what to do if an insurance company is acting in bad faith in order to minimize a client’s right to a legitimate financial settlement, Morris said.
