New York, New York (PRWEB) April 25, 2015
The federal multidistrict litigation (http://www.vaginalmeshlawsuit2015.com/) established for vaginal mesh lawsuits filed against C.R. Bard, Inc. continues to move forward in the U.S. District Court, Southern District of West Virginia. According to a Pretrial Order dated April 9th, a Scheduling Conference was convened that day, after certain defendants submitted amended responses to the Plaintiffs’ Master Long Form Complaint. The Order directed that any Preliminary Motions referenced during the Conference, as well as supporting memoranda, were to be submitted to the Court by April 23, 2015. Responses are due by April 30th, while replies must be submitted by May 4th. (In Re: C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation - MDL No. 2187)
“Our Firm is representing hundreds of clients in federal and state courts who have filed transvaginal mesh lawsuits against C.R. Bard and other device makers. We are pleased to see the federal litigation moving forward, and we will continue to monitor the proceeding closely for developments relevant to our clients’ claims,” says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm continues to evaluate lawsuits on behalf of women who were allegedly harmed by transvaginal mesh implants.
Transvaginal Mesh Litigations
Court documents indicate that more than 10,800 transvaginal mesh lawsuits are pending against C.R. Bard in the Southern District of West Virginia, all of which were filed on behalf of women who allegedly experienced severe and life-changing complications following implantation of surgical mesh devices to treat pelvic organ prolapse and stress urinary incontinence. Among other things, plaintiffs accuse C.R. Bard of failing to warn patients and the medical community about the risks allegedly associated with their transvaginal mesh products, and of failing to adequately test the devices to ensure their safety and effectiveness.
According to court records, the federal C.R. Bard litigation is just one of seven vaginal mesh proceedings currently underway in the Southern District of West Virginia, where more than 75,000 complaints have been filed. Other proceedings include: In Re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation - MDL No. 2325; In Re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation - MDL No. 2326; In Re: Coloplast Corp. Pelvic Support Systems Products Liability Litigation - MDL No. 2387; In Re: Cook Medical, Inc., Pelvic Repair System Products Liability Litigation - MDL No. 2440; In re: Ethicon, Inc. Pelvic Repair Systems Products Liability Litigation - MDL No. 2327; and In Re: Neomedic Pelvic Repair System Products Liability Litigation - MDL No. 2511.
Bernstein Liebhard LLP is also representing vaginal mesh plaintiffs in two multicounty litigations established in New Jersey Superior Court for cases filed in that state against C.R. Bard and Ethicon. Court records indicate that more than 9,500 complaints are currently pending in those proceedings. (In re: Pelvic Mesh Litigation/Bard, No. L-6339-10; In re: Pelvic Mesh/Gynecare Litigation, No. 6341-10)
Alleged victims of serious transvaginal mesh complications may be entitled to pursue a claim against the manufacturer of the device used in their surgery.
