Federal Judge Overseeing Ethicon Vaginal Mesh Lawsuit Denies Summary Judgment on Certain Claims, Bernstein Liebhard LLP Reports

Defendants in an Ethicon vaginal mesh lawsuit (http://www.transvaginalmeshlawsuithelp.com/) pending in the federal multidistrict litigation underway in the U.S. District Court, Southern District of West Virginia have been denied summary judgment on certain failure-to-warn claims contained in the complaint, Bernstein Liebhard LLP reports. In an Order dated July 8th, U.S. District Judge Joseph R. Goodwin found that issues of fact existed as to whether Ethicon, Inc.’s warnings regarding the risks associated with its Gynecare TVT Obturator (TVT-O) were adequate. (Huskey, et ux. v. Ethicon Mesh Litigation
The case at issue is one of nearly 20,000 vaginal mesh lawsuits pending against Ethicon in the Southern District of West Virginia. Court documents indicate that the complaint, which alleges the TVT-O device caused the plaintiff a number of serious transvaginal mesh complications, including erosion of the mesh, dyspareunia (pain during sexual intercourse), and constant vaginal and pelvic pain, is scheduled to go to trial on August 25, 2014. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is a member of the Plaintiffs’ Steering Committee in the federal Ethicon litigation. According to court records, more than 60,000 vaginal mesh lawsuits have been filed against several manufacturers in the Southern District of West Virginia. All of the lawsuits similarly allege that the defendants’ transvaginal mesh products were defectively designed,manufactured and marketed without adequate warnings regarding their risks. Mr. Grand is also a member of the Plaintiffs’ Steering Committee for a number of these proceedings, including: American Medical Systems, Inc. (MDL No. 2325); Boston Scientific Corp., (MDL No. 2326); and C.R. Bard, Inc., (MDL No. 2187)

Mr. Grand is also serving as Co-Liaison Counsel in a second Ethicon litigation underway in New Jersey’s Atlantic County Superior Court, where court documents indicate well over 5,000 transvaginal mesh lawsuits have been filed. Mr. Grand also served on the Plaintiff's trial team in the proceeding’s first trial of an Ethicon claim. That case concluded in March 2013, when the Plaintiff was awarded more than $11 million for injuries she suffered from Prolift mesh. (In re: Pelvic Mesh/Gynecare Litigation, No. 6341-1)
