Jorge Herrera, of The Herrera Law Firm, Inc., said people who were affected by the blast – whether they were injured, lost loved ones or sustained property damage – should take steps to protect themselves in the coming weeks.

We want to thank the brave men and women who served as first responders and the hard-working medical professionals who treated the injured.

A Texas fertilizer plant explosion lawyer at The Herrera Law Firm today commented on the disaster in West, Texas, in which at least 14 people were killed and hundreds were injured. The attorney offered tips to protect the rights of those who were injured or lost loved ones in the blast as well as those who sustained property damage.

Authorities are continuing to investigate the cause of the explosion on April 17, which was so intense it registered as a small earthquake, according to the Associated Press. More than a dozen people were killed and about 200 people were injured, according to the Associated Press. About 10 of the people who were killed were first responders, many of whom were volunteer firefighters, according to the AP. In addition to the injuries and fatalities, about 50 homes were destroyed and a nearby nursing home was severely damaged, the AP reports.

“Our thoughts and prayers go out to the families who were affected by the tragic explosion at the West Fertilizer Co.,” said Jorge Herrera, a Texas litigator who has handled serious accident claims. “We want to thank the brave men and women who served as first responders and the hard-working medical professionals who treated the injured. We extend our condolences to our Texas neighbors who lost loved ones or friends, or who suffered serious injuries or property damage.”
Herrera said the injured or those who lost loved ones should speak with an experienced personal injury lawyer promptly to protect their rights. “We understand that it’s an extremely difficult time right now for our neighbors in the Waco area,” Herrera said. “But it’s important to contact an accident attorney soon to protect your rights. As time passes, memories fade and evidence gets lost.”

In addition, Herrera said, anyone who has a home or business that was damaged by the blast may be entitled to compensation for their losses. Herrera offered the following tips to make a future claim easier to process:

  •     Keep expense receipts
  •     Gather photos of your property damage and other valuables that were damaged or destroyed
  •     Do not sign anything until you full understand your rights
  •     Beware of sham contractors

The Waco fertilizer plant explosion remains under investigation, but news reports have highlighted a spotty regulatory history at the West Fertilizer Co., according to the Los Angeles Times. The company was fined in 2006 and in 2011 after violations were discovered, the newspaper reported. In 2006, the company received a fine for not having a risk management plan in place, and in 2011, the company received a fine for violations, including transporting anhydrous ammonia without a security plan and carrying it in tanks that were improperly labeled, the Times reported.

“Sometimes companies put profits over safety,” Herrera said. “We’ve seen it time and again. We hope that this terrible accident is fully investigated and that whoever is found to be negligent will be held accountable. As attorneys, we want to help people obtain compensation and closure. But we also want to hold companies accountable and send a clear message that reckless behavior will not be tolerated.”
