A Boca Raton, Florida-based company has received a stern written warning from the Food and Drug Administration (FDA) to stop making claims that a product advertised as a flu remedy has undergone strict FDA testing, according to an Associated Press article published in the Palm Beach Post (Jan. 29, 2013). West Palm Beach dangerous drug lawyer Adriana Gonzalez, of Gonzalez & Cartwright, today said she hopes Florida residents take the FDA warning seriously and don’t substitute such products for a physician-approved shot created to prevent contracting the flu.

“Florida residents need to be savvy shoppers to avoid taking something that doesn’t treat serious health problems,” Gonzalez said. “The flu is a very dangerous illness that kills thousands of people each year. That’s why it’s so upsetting that some companies are trying to make a profit with products that haven’t gone through the FDA’s rigorous screening process. People’s lives are on the line. This is not the time for companies to try to cut corners.”

The FDA issued the written warning on Jan. 24 against Flu and Cold Defense, LLC, the manufacturers of GermBullet inhalers. According to the article in the Palm Beach Post, the makers of GermBullet issued a statement in January that the product “may help protect you so your immune system is not overwhelmed as the flu reaches epidemic levels."

The Palm Beach Post article reported that “FDA and FTC regulators take issue with that statement and a number of others from the company's website, including that the inhaler is ‘shown to reduce illness-causing bacteria, cold and flu viruses and fungi’.”

FDA regulators have observed a sharp rise in fake flu therapies in response to the current national flu epidemic, the Palm Beach Post article reports. “When there is a particular health issue in the news fraudulent products spike,” Howard Sklamberg, FDA’s director of compliance, stated in the Post. “So right now fraud products to prevent or treat the flu are big with scammers.”
Flu season in the winter of 2012-2013 has been one of the worst in recent years, according to the news story. The government does not keep statistics on adult deaths from the flu, but the Palm Beach Post reported that in an average year, the flu kills 24,000 people. This year, the death toll from the flu could exceed 36,000, according to Bloomberg news on Jan. 18.

Florida’s elderly population is especially vulnerable to the flu, according to the Post. More than half of the confirmed flu cases in the country are in people 65 years old and older, the Palm Beach Post reports.
