Wright Conserve hip replacement lawsuits continue to move forward in a multidistrict litigation currently underway in U.S. District Court, Northern District of Georgia, Bernstein Liebhard LLP reports. According to the Court’s website, a new Discovery Order has been issued directing Wright Medical Technology to produce additional documents regarding the Deferred Prosecution Agreement (DPA) the company entered into with the U.S. Attorney’s Office in New Jersey on September 29, 2010. According to the Order, the Court acted after Plaintiffs sought clarification of an earlier Order that required the company to produce documents relating to any physicians and consultants who may have worked on the Conserve product line. Wright Conserve Hip Replacement Lawsuits
The Wright Conserve hip litigation involves lawsuits related to the Wright Conserve Total Hip Implant System, Conserve Total A-Class Advanced Metal Hip Implant System, and the Conserve Resurfacing System. Wright Medical Technology entered into the DPA referred to in the litigation’s recent Discovery Order to resolve charges that it paid surgeons to use its products. In the Order, Judge William S. Duffey pointed out that Wright had acknowledged withholding materials relating to the DPA and to physician and consulting services related to that agreement, and that such materials could be related to Conserve hips.

Court records indicate about 40 Wright Conserve lawsuits are pending in the federal multidistrict litigation. All of the devices named in the lawsuits are metal-on-metal hip replacements, in which the femoral ball and cup are made from a chromium/cobalt alloy. On January 17th, the U.S. Food & Drug Administration (FDA) issued a Safety Communication warning that metal debris shed by all-metal hips can damage the bone and/or soft tissue surrounding the implant and joint. These metal ions cans also enter the bloodstream and travel to other parts of the body, where they may cause additional symptoms or illnesses, the agency said. The FDA has advised doctors to consider metal ion testing if patients are experiencing symptoms of hip implant failure. The agency also proposed a rule that would make all-metal hips ineligible for 510(k) approvals, which allowed devices like the Wright Conserve hip to come to market without premarket testing.*
