Wright Conserve hip replacement lawsuits continue to move forward in U.S. District Court, Northern District of Georgia, Bernstein Liebhard LLP reports. According to court documents, a Status Conference has been scheduled in the federal Conserve litigation for March 11, 2013. Court records also indicate that a total of 40 Wright hip implant lawsuits have been filed so far in the Northern District of Georgia. “We continue to hear from individuals fitted with metal hip implants, including the Wright Conserve, as well as the Wright Profemur Total Hip System, who have suffered debilitating complications due to the failure of their hips. We are pleased to see this litigation moving forward,” says Bernstein Liebhard LLP, a nationwide law firm that represents the victims of defective drugs and medical devices. The Firm is currently investigating lawsuits involving Wright Conserve hip implants, as well as Wright Profemur hip replacements.
Wright Conserve Hip Implant Lawsuits
The litigation underway in the Northern District of Georgia involves claims related to the Wright Conserve Total Hip Implant System, Conserve Total A-Class Advanced Metal Hip Implant System, and the Conserve Resurfacing System. All of the lawsuits allege that the Wright hip implants were defectively designed and caused personal injury to plaintiffs.
The Wright Conserve Hip Implant is a metal-on-metal hip replacement, in which the femoral ball and cup are made from a chromium/cobalt alloy. In a Safety Communication issued on January 17th, the U.S. Food & Drug Administration (FDA) cautioned that metal debris released by all-metal hips can damage the bone and/or soft tissue surrounding the implant and joint. Some of the metal ions released will enter the bloodstream and travel to other parts of the body, where they may cause additional symptoms or illnesses, the agency said. Among other things, the FDA advised doctors to consider metal ion testing if patients are experiencing symptoms of hip implant failure. The agency also proposed a rule that would make all-metal hips ineligible for 510(k) approvals, which allowed devices like the Wright Conserve to come to market without premarket testing.**
Bernstein Liebhard LLP is also investigating claims involving the Wright Profemur hip implant. The Wright Profemur has a modular design similar to the Stryker Rejuvenate and ABG II hip stems that were the subject of a recall in July 2012. In a filing with the U.S. Securities and Exchange Commission (SEC) last August, Wright Medical Technology, Inc. conceded that there is a possibility that the Stryker hip recall might impact sales of the Profemur products. “Although Stryker's recalled modular hip stems differ in design and material from our Profemur modular neck hip stems, there is a risk that Stryker's recall and the resultant publicity could negatively impact sales of modular neck systems of other manufacturers, including our Profemur system, even if the issues cited by Stryker are unique to Stryker products,” the company said.***
Victims of alleged metal-on-metal hip replacement injuries may be entitled to compensation for their medical bills, lost wages, pain and suffering, and other damages. Bernstein Liebhard LLP is actively filing lawsuits stemming from the DePuy ASR hip recall in the federal litigation underway in U.S. District Court, Northern District of Ohio. Grand is serving on the Plaintiffs’ Steering Committee in the federal DePuy Pinnacle litigation underway in U.S. District Court, Northern District of Texas, involving a metal-on-metal version of the Pinnacle Hip Replacement System.
