Court Enforces Order Against Gowlings

Canada's 2nd largest law firm fails in attempt to be removed from a major lawsuit.

Calgary, AB Lawyers for Canada's second largest law firm, Gowling Lafleur Henderson LLP., Patrick Hannon, a former Director of Mines from Halifax, Nova Scotia, and his engineering firm, Minetech International Limited, had blatantly refused to sign an Order pronounced by a Calgary Court against them. The verdict of a February 2006 hearing in the Calgary Court did not remove the Defendants from a major lawsuit.

Gowling Lafleur Henderson LLP., who employs over 700 lawyers, Patrick Hannon and Minetech International Limited refused to abide by the longstanding normal procedure; however the Court intervened on November 8, 2006, signed and entered the Order therefore making the decision legally binding. No appeal was filed.

In a Statement of Claim filed on April 26th, 2004 (Action no. 0401-06677) the Plaintiff - the British Columbia based Peregrine Trust - alleges that Gowling Lafleur Henderson LLP. and two of its attorneys were negligent and/or conspired with other Defendants. When contacted for comment, representatives for Gowling Lafleur Henderson LLP. did not return calls.

Mark Freeman, the attorney for the Plaintiff, confirmed that the Order was indeed entered by the Court on November 8, 2006. Freeman is a partner at the Calgary based Docken and Company.

This litigation has stretched to the American judicial system. Nevada's largest law firm - Lionel Sawyer & Collins has launched a suit on behalf of the Plaintiff in the District Court of Clark County (Case No. A525434).

Thus far 132 subpoenas have been issued in this case to persons or entities throughout various countries. Another 100 subpoenas are expected to be issued before the end of the year according to Satinder Dhillon, spokesman for the Peregrine Trust. Dhillon went on to say: "This alleged massive fraud is now becoming a very transparent series of transactions".
