The action was filed in the United States District Court of the Central District of California (Case No. CV08-07968) and it alleges the improper acts by Ohio-based NetNetStore.com, Inc. and Rakatak.com, which infringed upon The Ab Coaster Company's intellectual property rights and risked interfering with The Ab Coaster Company's strong relations with its customers and authorized dealers. The complaint alleges that NetNetStore and Rakatak committed patent and trademark infringement, as well as unfair competition, by selling illicit direct copies of the patented Ab Coaster® product and using the federally registered Ab Coaster® trademark. The Ab Coaster Company is taking all legal and equitable steps to ensure that NetNetStore and Rakatak do not succeed with their improper actions.
In addition to protecting its proprietary rights in the Ab Coaster product, The Ab Coaster Company also seeks to protect its dealers and customers from counterfeit and infringing products that are distributed illegally.
