Bill Gaffigan presented “Valuation and Solvency Opinions: When is a Company Solvent?” to the Atlanta Chapter of the National Association of Certified Valuation Analysts, ( on October 22, 2010. During a luncheon and meeting focused on “Expanding Your Practice in New Directions”, Mr. Gaffigan addressed the growing need for companies to determine whether they are solvent and how valuation professionals can assist not only with that determination but also by advising struggling businesses on how to preserve and enhance value.

Mr. Gaffigan advocates a team approach when determining value by working with a client’s in-place attorneys and accountants. “By the time a company files for Chapter 7, often it has been so beaten down that the impact is severe not only on the emotions and livelihood of the owners, but employees, customers and suppliers as well. It is the responsibility of the valuation analyst, as well as other advisors, to help the company maintain as much value as possible, and if it cannot be avoided, to support the client throughout the entire bankruptcy process.” In his presentation, Mr. Gaffigan reviewed the Federal definition of insolvency, explained the criteria for “Going Concern” determination, and examined the various methods used to ascertain solvency once going concern status has been verified.
