$3.5 Million Settlement in Norfolk, VA Wrongful Death Truck Wreck Case

A Portsmouth, VA man was killed after a big rig crashed into the car he was in while traveling on Interstate 264 (I-264) in Norfolk. The accident occurred on Interstate 264 (I-264) in Norfolk, Virginia (VA) when a commercial truck driver in a big rig rear ended a passenger vehicle. The 18-wheeler and the passenger vehicle caught on fire. Our client, a 25-year-old man from Portsmouth, VA was trapped in the passenger vehicle and died as a result.

During deposition, the trucker admitted that he did not see the passenger vehicle until a few seconds before his tractor-trailer hit the car. Mr. Cooper and Mr. Appleton also established that the story provided by the trucker to state troopers after the crash was inaccurate. In addition, the attorneys conducted extensive interviews and developed custom graphics and other materials to illustrate the impact of the loss on our victim’s family.

The trucker’s defense attorneys argued that the driver of the passenger vehicle caused the crash by going 25 miles per hour on the highway at night without hazards on.

However, the evidence revealed that the trucker violated several safety rules from the Virginia Commercial Drivers License Manual. Mr. Cooper and Mr. Appleton also uncovered evidence of poorly controlled diabetes which the trucker had failed to adequately treat prior to the truck wreck. The trucker did not follow his doctor's orders and did not take the medication properly.

After all the evidence was presented in mediation, Mr. Cooper and Mr. Appleton were able to obtain a sizable, $3.5 million settlement. These funds will help support our client’s only surviving beneficiary, his five-year-old daughter.
