The lawsuit, case no. 2009-79547 in the 333rd District Court of Harris County, Texas, alleged the employer failed to provide a safe workplace and that the owner of the compactor was negligent for delivering a defective compactor.

The trial against the owner of the defective compactor is currently set for April in Houston, Texas.
