Pelvic mesh litigation status conferences ordered and discovery stay lifted in transvaginal mesh lawsuits, Bernstein Liebhard LLP reports.

● upcoming status conference in certain Virginia federal lawsuits; and
● discovery stay lifted in certain Virginia federal lawsuits.

The New Jersey state court actions, In re Pelvic Mesh/Gynecare Litigation, No. 6341-10 (N.J. Super Ct.) and In re Pelvic Mesh Litigation/Bard No. L-6339-10 (N.J. Super. Ct.), are two consolidated actions of all the transvaginal mesh lawsuits filed in New Jersey state court. A case management conference is scheduled to take place in New Jersey state court on Thursday, July 19, 2012 at 10:00 a.m.* These actions are pending before the Honorable Carol E. Higbee in the Superior Court of New Jersey Law Division, Atlantic County. Firm partner Jeffrey S. Grand serves as Co-Liaison Counsel in these cases.

Federal Transvaginal Mesh Lawsuits Also Proceeding

In addition to tomorrow’s proceedings, an upcoming conference has been scheduled in the federal pelvic mesh litigation, In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation (“MDL No. 2327”), pending in the U.S. District Court for the Southern District of West Virginia before the Honorable Joseph R. Goodwin. In addition to the federal pelvic mesh litigation against Ethicon, Judge Goodwin is also overseeing the following related actions against other transvaginal mesh manufacturers: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326”); and In re: C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation (“MDL No. 2187”). Mr. Grand is serving on the Plaintiffs’ Steering Committee in each of these federal pelvic mesh lawsuits.

According to a pre-trial order issued by Judge Goodwin on June 1, 2012, the next Ethicon status conference will be held on Thursday, July 26, 2012 at 1:00 p.m. in the Robert C. Byrd United States Courthouse.** According to a second order issued on June 14, 2012, Judge Goodwin lifted a stay on the discovery process in the Ethicon pelvic mesh litigation.*** Previously, Judge Goodwin had stayed all outstanding discovery proceedings while the parties dealt with other preliminary matters in the federal transvaginal mesh lawsuits. The parties are now able to move forward with discovery in earnest.
